1. Introduction

Welcome to Golf Tracker Pro. These Terms of Service ("Terms") govern your use of our website, mobile application, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

Golf Tracker Pro is operated from the United Kingdom. These Terms are governed by English law, and you agree to the exclusive jurisdiction of the English courts.

2. Eligibility

You must be at least 16 years old to use this Service. By using the Service, you represent and warrant that you meet this age requirement. If you are under 18, you confirm that you have obtained parental or guardian consent to use the Service.

3. Account Registration

To access certain features of the Service, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorised use of your account

We reserve the right to suspend or terminate your account if any information provided is inaccurate, false, or violates these Terms.

4. Free and Paid Services

4.1 Free Tier

The Service offers a free tier that includes basic features such as round tracking, handicap calculation, group rounds, and leaderboards. The free tier is provided "as is" without any guarantees of availability or functionality.

4.2 Pro+ Subscription

Pro+ is our premium subscription service that provides additional features including advanced analytics, club management, and competitive season tracking. Pro+ subscriptions are billed monthly at the rate displayed at the time of purchase.

4.3 Payment Terms

Payments are processed securely through LemonSqueezy, our third-party payment processor. By subscribing to Pro+, you agree to:

• Provide valid payment information
• Authorise recurring charges to your payment method
• Pay all fees and charges incurred through your account

4.4 Cancellation and Refunds

You may cancel your Pro+ subscription at any time through your account settings or the customer portal. Upon cancellation:

• You will retain access to Pro+ features until the end of your current billing period
• No refunds will be provided for partial billing periods
• Your account will revert to the free tier after the subscription period ends

Under the Consumer Contracts Regulations 2013, you have the right to cancel within 14 days of purchase for a full refund, provided you have not substantially used the Service during this period.

5. User Conduct

When using the Service, you agree not to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Submit false, misleading, or fraudulent information
• Harass, abuse, or harm other users
• Attempt to gain unauthorised access to the Service or other users' accounts
• Use the Service for any commercial purpose without our consent
• Interfere with or disrupt the Service or servers
• Use automated means to access or scrape the Service

6. User Content

You retain ownership of any content you submit to the Service, including golf scores, course information, and profile data ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free licence to use, store, and process this content for the purpose of providing the Service.

You are solely responsible for your User Content and represent that you have the right to submit such content and that it does not violate any third-party rights.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by Golf Tracker Pro and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express written permission.

8. Third-Party Services

The Service may contain links to or integrate with third-party services, including but not limited to LemonSqueezy for payment processing. We are not responsible for the content, privacy practices, or terms of these third-party services. Your use of third-party services is at your own risk and subject to their respective terms and policies.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure, or that defects will be corrected. Handicap calculations are provided for informational purposes only and may differ from official handicap indices issued by golf governing bodies.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GOLF TRACKER PRO BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

11. Indemnification

You agree to indemnify and hold harmless Golf Tracker Pro and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms.

12. Account Termination

You may terminate your account at any time by using the account deletion feature in your settings. Upon termination:

• Your account and all associated data will be permanently deleted
• Any active Pro+ subscription will be cancelled
• This action cannot be undone

We reserve the right to suspend or terminate your account at any time for violation of these Terms, with or without notice.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on the Service and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.

14. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or relating to these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer, you may also have rights under the laws of your country of residence, and nothing in these Terms affects those rights.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
